§ 1. General
1.1 Euro Interior Innovators offers through the online shop under the domain www.eurointeriorinnovators.com in particular goods in the field of interior design and home decor. With the exception of exhibits, the goods are exclusively new.
1.2 The present terms and conditions apply to the entire business relationship between “Euro Interior Innovators” and the customer.
1.3 Customers within the meaning of the above conditions of sale are both consumers and entrepreneurs.
1.3.1 A consumer is any natural person with whom a business relationship is entered into and who acts for a purpose that can neither be attributed to their commercial nor their independent professional activity.
1.3.2 Entrepreneur within the meaning of these terms and conditions is any natural or legal person or a legal partnership with whom a business relationship is entered into and who acts in the exercise of their commercial or independent professional activity.
§ 2 Storage and viewing of the contract text
2.1 The terms and conditions can be viewed in the online shop at any time on the detail page “terms and conditions”, which can be reached via the link “terms and conditions” in the lower area of the online shop. There you have the option to save or print out the terms and conditions.
There are two options for saving:
A) The use of the function of the Internet service program (= browser), there mostly under “File” and then in the following menu “Save as”.
B) In the upper area of the terms and conditions detail page there is the word “save” with the corresponding symbol. Clicking on the word or symbol opens a PDF document that can then be saved. To open the document, you either need the free Adobe Reader program (available at www.adobe.de) or comparable programs that can open a PDF.

2.2 There is also the possibility of simply archiving the data of your own order in two different ways:
A) In order step 3 “Check & Order” in our online shop, the data of the order as well as our terms and conditions can be saved or printed out with the help of the functionalities of the browser. In addition, the terms and conditions can be printed out using the directly integrated “print” functions.
B) After the order has been successfully completed, an automatic order confirmation is sent to the email address given in the order. This confirmation e-mail confirms receipt of the online order and once again contains all the data relating to the order in question. This e-mail can then be printed out or saved using the e-mail program.
§ 3 Conclusion of the contract
3.1 The products and services listed in the online shop do not constitute binding offers. The offers are rather an invitation to the customer to submit a binding offer to “Euro Interior Innovators”.
3.1.1 Product images as well as drawings or illustrations are only intended as an approximate product description. The information in the order confirmation is decisive for the product quality. Products may differ in shade, grain and pattern from the product images shown in the online shop.
3.1.2 The products listed in the “Euro Interior Innovators” online shop, in particular electronic components and devices, meet the requirements of the German market (voltage 230 Volt; connection connections according to Western European standards).
3.2 Orders for Products
3.2.1 With the order – be it by telephone, in writing or electronically – the customer makes a binding offer to enter into a contract. “Euro Interior Innovators” will immediately confirm the access of this order to the customer with an order confirmation. In this respect, however, it is not a matter of accepting the order; however, this can be combined with the declaration of acceptance.
3.2.2 “Euro Interior Innovators” is entitled to accept the customer’s contract offer within three working days of receipt. Acceptance can be declared either by express notification with the order confirmation or by delivery of the goods.
3.2.3 “Euro Interior Innovators” assumes no procurement risk and reserves the right to release itself from the obligation to fulfill the contract in the event of incorrect or improper self-delivery by sub-suppliers. The responsibility of “Euro Interior Innovators” for intent or negligence in accordance with the liability regulations of these terms and conditions in accordance with § 13 remains unaffected. In the event of unavailability or only partial availability of the service, “Euro Interior Innovators” will inform the customer immediately; in the event of withdrawal, the consideration will be immediately reimbursed to the customer.
3.2.4 “Euro Interior Innovators” only delivers goods to customers in countries that can be selected as delivery countries in the “Euro Interior Innovators” shopping cart. Deliveries to other delivery countries are made either via the website www.eurointeriorinnovators.com or on request.
3.2.5 The following special rules apply to contracts with customers with a foreign connection:
3.2.5.1 Consumers with a billing address in an EU country
If a consumer with a billing address in an EU country would like to buy goods from “Euro Interior Innovators”, he can choose “Shipping” (3.2.5.1.1) when choosing a “delivery country” listed in the online shop. If the customer wishes goods to be shipped to a delivery country not listed in the online shop, the order will be checked by “Euro Interior Innovators” (3.2.5.1.2).
3.2.5.1.1 Shipping to a delivery country listed in the online shop
If a consumer with a billing address in an EU country buys goods from “Euro Interior Innovators” and chooses shipping to a delivery country specified in the online shop as “delivery country”, “Euro Interior Innovators” delivers the goods to the selected delivery country and calculates the costs in this delivery country applicable sales tax.
3.2.5.1.2 Shipping to a delivery country not listed in the online shop
If you choose to ship the goods to a delivery country not listed in the online shop, the order will be sent to “Euro Interior Innovators” for testing. “Euro Interior Innovators” checks whether the order can be sent to the selected delivery country. “Euro Interior Innovators” reserves the right to refuse orders after they have been checked. If “Euro Interior Innovators” accepts the order, “Euro Interior Innovators” will contact the consumer in order to coordinate the shipping modalities.
3.2.5.2 Entrepreneurs with a billing address in an EU country
If an entrepreneur with a billing address in an EU country (except Germany) would like to buy goods from “Euro Interior Innovators”, he can choose “Shipping” (3.2.5.2.1) when choosing a delivery country listed in the online shop.
If an entrepreneur with a billing address in Germany would like to buy goods from “Euro Interior Innovators”, he can choose “Shipping” (3.2.5.2.1) by choosing a delivery country listed in the online shop.
If the entrepreneur wishes the order to be sent to a delivery country not listed in the online shop, “Euro Interior Innovators” will check the order on request (3.2.5.2.2).
In principle, the entrepreneur must provide evidence of his entrepreneurial status. Proof of a valid sales tax identification number (UStID-Nr.) Is required for proof of entrepreneurial status. The sales tax identification number should be specified when ordering the goods.
3.2.5.2.1 Shipping with a billing address in an EU country
If an entrepreneur with a billing address in an EU country buys goods from “Euro Interior Innovators” and chooses shipping to an EU country specified in the online shop as the “delivery country”, “Euro Interior Innovators” delivers the goods to the selected EU country tax-free.
3.2.5.2.2 Shipping to a delivery country not listed in the online shop
If you choose to ship the goods to a delivery country not listed in the online shop, the order will be sent to “Euro Interior Innovators” for testing. “Euro Interior Innovators” checks whether the order can be sent to the selected delivery country. “Euro Interior Innovators” reserves the right to refuse orders after they have been checked. If “Euro Interior Innovators” accepts the order, “Euro Interior Innovators” will contact the entrepreneur to coordinate the shipping modalities. Delivery to an entrepreneur in an EU country not listed in the online shop is generally tax-free after submission and successful checking of the sales tax identification number (European VAT ID no. Except German VAT ID no.). In the case of delivery to a non-EU country not listed in the online shop, delivery is generally tax-free, without submitting a sales tax identification number.
3.2.5.3 Consumers and entrepreneurs with a billing address in a non-EU country
If a customer wants to buy goods from “Euro Interior Innovators” regardless of whether they are a consumer or an entrepreneur with a billing address in a non-EU country listed as “delivery country” in the online shop, the customer has the following options:

The customer with a billing address in a non-EU country listed as “delivery country” in the online shop can choose to have the goods shipped by “Euro Interior Innovators” to the non-EU country specified in the billing address (3.2.5.3.1.1).
3.2.5.3.1.1 Shipping to a delivery address in a non-EU country
To do this, the customer must select “shipping” the goods to the non-EU country when ordering. “Euro Interior Innovators” sends the goods to the non-EU country specified in the billing address and takes care of all customs formalities and calculates the applicable sales tax in the non-EU country.
3.2.5.3.2 Delivery address in an EU country listed in the online shop
If a customer with a billing address in a non-EU country listed as “delivery country” in the online shop would like to have the goods delivered by “Euro Interior Innovators” to an EU country or to collect them from the issuing points provided by “Euro Interior Innovators” in the Federal Republic of Germany , the order is sent to “Euro Interior Innovators” for testing. “Euro Interior Innovators” checks whether the order can be sent to the selected EU country or picked up and brought to the respective EU country by the customer himself. The customer will then be contacted by “Euro Interior Innovators” in order to coordinate the shipping modalities and the collection modalities. In such cases, “Euro Interior Innovators” reserves the right not to confirm the order.
3.2.5.3.2.1 Shipping
When the goods are dispatched, the sales tax applicable in the EU country will be charged.
3.2.5.2 If members of NATO armed forces stationed in the Federal Republic of Germany conclude sales contracts with “Euro Interior Innovators”, these sales contracts will be treated as sales contracts with German customers and deliveries within Germany. In particular, the applicable sales tax under German law will be charged.
3.2.5.3 If a customer with a billing address in a non-EU country, which is not expressly named as the country of delivery in the “Euro Interior Innovators” online shop, wants to buy goods from “Euro Interior Innovators” and should not buy the goods in an online shop Non-EU countries expressly named as the country of delivery are delivered by “Euro Interior Innovators” or taken by the customer after collection to the issuing points provided for this purpose by “Euro Interior Innovators” in the Federal Republic of Germany, “Euro Interior Innovators” will examine the customer’s order upon request. 3.2.6 We only sell all products in normal household quantities. This applies both to ordering a product in a single order and to multiple orders for the same product that are placed in a close, temporal context. If goods are ordered in non-household quantities, we will check your order. We reserve the right to refuse your order or to charge you additional shipping costs.
§ 4 Cancellation Policy
According to the provisions of distance selling law, consumers have a right of withdrawal in relation to purchased goods that are not excluded from withdrawal in accordance with the following instruction:

You can use the attached withdrawal form template for this purpose, but this is not mandatory. In order to meet the cancellation deadline, it is sufficient for you to send your notification that you are exercising your right of cancellation before the cancellation period has expired.
Consequences of withdrawal
If you withdraw from this contract, we will have given you all payments that we have received from you, including delivery costs (with the exception of additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for the repayment.
In the case of goods that can be sent as parcels, we can refuse to repay until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.
You must return or hand over the goods that can be sent as parcels immediately and in any case no later than fourteen days from the date on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. We pick up the goods that cannot be sent as parcels.
You bear the direct costs of returning the goods. For goods that cannot be sent as parcels, the costs are a maximum of EUR 190.90 (return within Germany), and a maximum of EUR 302.09 (return from abroad).
You only have to pay for any loss in value of the goods if this loss in value is due to handling you that is not necessary to check the nature, properties and functionality of the goods.
Note
You can use the online return form to prepare the goods for shipping. Here, labels are created for you that you can use to return the goods. In the case of goods that cannot be sent as parcels, one of our forwarders will be informed who will contact you and arrange a pick-up with you. This is an offer to you, which, however, is not a prerequisite for the effective exercise of the right of withdrawal.
The right of withdrawal does not apply to distance contracts
• for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
• for the delivery of goods that can spoil quickly or whose use-by date is quickly exceeded.
The right of withdrawal expires prematurely in the case of distance contracts, e.g.
• for the delivery of sealed goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
• for the delivery of goods if they were inseparably mixed with other goods after delivery due to their nature.

§ 5 Prices, delivery and shipping costs
5.1 Prices
5.1.1 Product Prices
The prices listed in the online shop are final prices. They therefore include all price components including any taxes that may be incurred. There are no additional duties, fees or taxes for cross-border deliveries to Switzerland.
5.1.2 The delivery and shipping costs incurred are not included in the purchase price. When the goods are dispatched both domestically and abroad, shipping costs are generally incurred, which the buyer also has to bear and which are based on the specific item description and the shipping information provided therein, or there are more details on the calculation this indicated by the online shop.
5.1.3 The shipping costs per order generally refer to a delivery unless otherwise agreed. If necessary, partial deliveries can also be made for an additional charge. Orders with an order value of EUR 2,000 or more will be sent free of charge in one delivery within Germany (mainland only).
5.1.4 Higher shipping costs may be charged for orders that are not for normal household quantities.
§ 6 Terms of Payment
6.1 Unless otherwise agreed, the customer can use the payment options specified in the online shop, including bank transfer, advance payment, credit card or PayPal. Additional costs may arise depending on the payment method.
6.1.1 Euro Interior Innovators reserves the right not to always offer all payment methods. Euro Interior Innovators also reserves the right to change the payment method if the payment method chosen by the customer does not work.
6.1.2 Provided the shipment is within the EU, the customer agrees that the invoice will only be issued electronically. The invoice will no longer be enclosed with the delivery in paper form, but will only be sent by email in PDF format. In addition, the customer can download, save and print out the electronic invoice in PDF format via his customer account. To view the PDF files you need Acrobat Reader, which you can download free of charge from Adobe.
§ 7 Right of Retention
The customer can only assert a right of retention if his counterclaim is based on the same contractual relationship.
§ 8 Delivery and Shipping Conditions
8.1 Delivery and shipping conditions for all products
8.1.1 The goods are delivered – unless otherwise agreed in individual cases – against prepayment and by dispatch.
8.1.1.1 For items that are marked with “immediately available”, Euro Interior Innovators offers standard shipping to all countries that can be selected as delivery countries in the shopping cart.
8.1.1.1.1 Standard shipping: Shipping takes place on the working day after a successful order check, delivery of the order confirmation and receipt of full payment. For parcels, the transport time within Germany (mainland only) is 1 to 3 working days from the date of dispatch.
8.1.1.2 If the expected delivery date falls on a Sunday or public holiday, regardless of the type of delivery selected, the delivery date will be postponed to the next working day.
8.1.2 The goods are stored free of charge for a maximum of 6 months. After that, storage costs arise.
8.1.3 If the customer is an entrepreneur, the risk of accidental loss and accidental deterioration of the goods passes to him as soon as the shipment has been handed over to the person responsible for the transport.
8.1.4 In the case of consumers, the risk of accidental loss and accidental deterioration of the goods in the case of mail order purchases is transferred to the consumer when the goods are handed over to the consumer.
8.1.5 With regard to the transfer of risk, the transfer is the same if the customer is in default of acceptance.
8.1.6 The customer assures that he has given the correct and complete delivery address when placing his order. Should there be additional costs for the dispatch due to incorrect address data – e.g. new shipping costs – the customer has to reimburse them.
8.1.7 Upon delivery, the goods are delivered to the curb by the shipping company. If the size of the goods allows delivery by a parcel service, the goods will be delivered to your first door.
§ 9 Retention of title
“Euro Interior Innovators” retains ownership of the goods until full payment has been made. If the customer is an entrepreneur, “Euro Interior Innovators” reserves ownership of the goods until all claims against the buyer arising from the business relationship have been met.
§ 10 Warranty
10.1.1 The customer, who is a consumer, is initially entitled to supplementary performance if there is a defect in the goods. The consumer can choose between the removal of the defect or the delivery of a defect-free item. “Euro Interior Innovators” is entitled to refuse the selected type of supplementary performance if this is only possible at disproportionate costs.
10.1.2 If the supplementary performance has failed, the customer, who is a consumer, can, in accordance with the statutory provisions, demand a reduction in the purchase price (reduction), withdraw from the contract, demand compensation or reimbursement of wasted expenses. If he demands compensation or reimbursement of wasted expenses, “Euro Interior Innovators” is liable in accordance with § 12 of these conditions.
10.2.1 If the customer is an entrepreneur, he must inspect the goods immediately after delivery, insofar as this is feasible in the ordinary course of business, and report obvious defects to the goods “Euro Interior Innovators” immediately, otherwise warranty claims are excluded. A notification of defects must be made in text form, e.g. by letter, fax or email to “Euro Interior Innovators”. Timely dispatch of the notification of defects is sufficient to meet the deadline.
10.2.2 If the customer, who is an entrepreneur, is entitled to warranty claims, “Euro Interior Innovators” can choose whether to remedy the defect or deliver new goods.
10.2.3 If the customer, regardless of whether they are a consumer or an entrepreneur, willfully or negligently fail to recognize that the goods are actually not defective or that the defect that has occurred cannot come from the area of responsibility of “Euro Interior Innovators”, and if he still asserts his warranty rights, so is he obliges “Euro Interior Innovators” to reimburse the costs incurred as a result of an unjustified request for the removal of defects.
10.3.1 The limitation period for the rights of a consumer in the event of defects in a new item is two years, for the rights of an entrepreneur one year from delivery of the goods. These associated relief of the statute of limitations do not apply if and to the extent that “Euro Interior Innovators” is liable according to § 13 of these General Terms and Conditions or it concerns the real right of a third party on the basis of which the surrender of the delivery item can be demanded.
10.3.2 If a used item has been sold and the customer is a consumer, the buyer’s warranty claims expire one year after delivery of the goods. This exclusion of warranty does not apply if and to the extent that “Euro Interior Innovators” is liable in accordance with Section 13 of these General Terms and Conditions or it concerns the real right of a third party on the basis of which the surrender of the delivery item can be requested.
10.3.3 The entrepreneur has no warranty claims with regard to used items; this also applies to defects that arose after the conclusion of the contract but before the transfer of risk. These associated easing of the statute of limitations do not apply if and to the extent that “Euro Interior Innovators” is liable in accordance with Section 13 of these General Terms and Conditions or it concerns the real right of a third party on the basis of which the surrender of the delivery item can be demanded.
10.4 The products sold by “Euro Interior Innovators” should only be installed by suitable specialist companies, but not by appropriate laypeople. If the products are not installed and / or used properly, claims from any (manufacturer) guarantee are excluded. Liability or warranty for damage or defects resulting from improper installation and / or improper use of the products sold cannot be assumed.
10.5 Entrepreneurs’ rights of recourse, in particular in §§ 445a, 478 BGB, remain unaffected by the provisions of §§ 11.1 to 11.4 of these GTC.
§ 11 Transport Damage
The customer will support “Euro Interior Innovators” in the event of transport damage to the best of his ability, provided that claims are asserted against the transport company or transport insurance concerned.
11.1 If the (partial) loss or damage is not externally recognizable, the customer must notify “Euro Interior Innovators” within five days of delivery or within seven days of delivery to the transport company in order to ensure that any claims against the transport company are timely be invoked.
11.2 Any rights and claims of the customer, in particular his rights in the event of defects in the item, remain unaffected by the provisions of § 12.1 of these General Terms and Conditions. These therefore do not include a deadline for the customer’s rights in accordance with Section 11 of these General Terms and Conditions.
§ 12 Liability
12.1 According to the statutory provisions, “Euro Interior Innovators” is fully liable for damage to life or health based on an intentional or negligent breach of duty as well as for other damage based on an intentional or grossly negligent breach of duty as well as malice. In addition, “Euro Interior Innovators” is fully liable for damages that are covered by liability according to mandatory statutory provisions, such as the Product Liability Act, as well as in the case of the assumption of guarantees.
12.2 “Euro Interior Innovators” is liable for such damages that are not covered by § 13.1 and that are caused by simple or slight negligence, insofar as this negligence relates to the breach of contractual obligations, the fulfillment of which makes the proper execution of the contract possible and compliance with them the customer can trust regularly (so-called cardinal obligations). The liability of “Euro Interior Innovators” is limited to the foreseeable damage typical for the contract.
12.3 In the case of slightly negligent breaches of contractual obligations that are neither covered by § 13.1 nor § 13.2 (so-called insignificant contractual obligations), “Euro Interior Innovators” is liable to consumers – this is limited to the foreseeable damage typical for the contract.
12.4 Any further liability is excluded. Reference is made to the limitations of liability in accordance with Section 10.4.
§ 13 Note according to the Battery Act
Since the shipments may contain batteries and rechargeable batteries, “Euro Interior Innovators” is obliged under the Battery Act (BattG) to inform customers of the following: Batteries and rechargeable batteries may not be disposed of with household waste. Rather, customers are legally obliged to return used batteries and accumulators. Old batteries can contain pollutants which, if not properly stored or disposed of, can damage the environment or human health. However, batteries also contain important raw materials such as iron, zinc, manganese or nickel and can be recycled. After use, customers can either return the batteries to “Euro Interior Innovators” or return them free of charge in the immediate vicinity (e.g. in stores or at municipal collection points or directly at “Euro Interior Innovators”). The sale in sales outlets is limited to the quantities customary for end users as well as those used batteries that the distributor carries or has carried as new batteries in its range.
The symbol with the crossed-out garbage can means that batteries and rechargeable batteries must not be disposed of with household waste. The following symbols with the following meanings can also be found under this symbol:
Pb: battery contains lead,
Cd: battery contains cadmium,
Hg: battery contains mercury
§ 14 Note according to the Consumer Dispute Settlement Act (VSBG)
Euro Interior Innovators does not take part in dispute settlement proceedings before a consumer arbitration board. Euro Interior Innovators is not obliged to do this either.
§ 15 Final Provisions
15.1 The relationships between the contracting parties are governed by the law applicable in the Federal Republic of Germany. In the case of customers who conclude contracts for the delivery of movable objects for a purpose that cannot be attributed to the professional or commercial activity of the consumer, this choice of law only applies insofar as the protection granted by mandatory provisions of the law of the state in which the Consumer has his habitual residence is withdrawn.
15.2 The provisions of the United Nations Convention on Contracts for the International Sale of Goods (UN Sales Law) do not apply.
15.3 If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of performance and jurisdiction for all disputes arising from this contractual relationship is the place of business of “Euro Interior Innovators”. The same applies in the event that the customer, who is an entrepreneur, does not have a general place of jurisdiction in Germany, or in the event that the usual place of residence is not known at the time the action is brought. Even then, the exclusive place of jurisdiction for all disputes arising from this contract is the place of business of “Euro Interior Innovators”. The authority to call the court at another legal place of jurisdiction remains unaffected.
